Fighting CPS and ACS

Fighting CPS and ACSWhen the allegations of child abuse or child neglect are made to CPS or ACS and investigation ensues. The reports are deemed credible by the investigator. These reports can be based on misinterpretations of stories related by children to teachers, nurses or other children. The first step the investigator takes is to interview the children with or without the parent’s consent.

The Interview

If you are contacted by CPS, you are going to be subject to an interview. It is strongly suggested you meet with an experienced ACS or CPS defense attorney and prepare yourself for the interview. You need to be careful as to what you say during the interview. This is especially true if there has been a situation where your child has been injured due to an accident or unusual circumstance. You must understand what is at stake in these situations. A natural reaction for a parent would be to explain the situation to clear up any distortions of the facts or allegations involving the injury to the child. Unfortunately statements made by you to an investigator could cause you to be arrested due to your incriminating yourself. You could be found guilty of child neglect or child abuse based on your statements to the investigator.

CPS and ACS Defense Lawyer

Sometimes CPS and ACS investigators misinterpret the evidence, twist the evidence or reach a conclusion the parents are lying. It is imperative before you have this discussion with the CPS or ACS investigator that you meet with a CPS or ACS attorney to avoid being subject to abuses of the process and misinterpretation of the facts involving the injury to your child.
