In the State of New York there is a long list of individuals who are required to report or cause a report to be made where there is reasonable cause that a child coming before them is abused, neglected or maltreated.These individuals are called mandatory reporters.These individuals are required to report that there is reasonable cause to suspect a child is abused or maltreated by either a parent, legal guardian or other person legally responsible for the child.
The following is a list of all of the mandatory reporters in the State of New York:
- Social workers
- Teachers and school personnel
- Child care providers
- Law enforcement individuals
- Health care workers which include:
Physicians, physician assistants, surgeons, medical examiners, coroners, dentists, dental hygienists, osteopaths, optometrists, chiropractors, podiatrists, residents, interns, psychologists, registered nurses, social workers, or emergency medical technicians
When a mandatory reporter is required to report suspected child abuse or child neglect this requirement causes them to immediately notify CPS or ACS. This also applies to institutions, schools, facilities, agencies, organizations, partnerships or corporations that employ the mandatory reporter.
The Report
The report by a mandatory reporter immediately causes ACS and CPS to initiate an investigation. The ACS or CPS investigator will assume the report is true. Their job is to gather evidence to support the report.
