Individuals who are the subject of either child abuse, child neglect or child maltreatment reports are legally entitled to copies of the information concerning the reports made against them. These reports are on file at the Statewide Central Register (SCR). One can sign into the office of Central Register and request information using a portal created by the New York government. In addition, a written request can be made by an individual who seeks to find information out from the Central Register about him or her.
False Reports of Child Abuse
The State of New York Office of Children Family Services takes in many false reports of child abuse and child neglect. However, when they take in the false reports, they investigate each report and they try to find evidence that the false reports are actually true reports, instead of quickly realizing the report is false and dropping the case.
Presumption of Guilt
If you are charged with a crime in the United States you are presumed innocent by law. A prosecutor has to prove to a jury that you committed a crime. You are entitled to receive the Miranda Rights before you say something to the police that will incriminate you. With regard to CPS and ACS you are presumed guilty of the allegations against you. The CPS or ACS investigator’s job is to find evidence of your guilt and present it to a Judge. If you are under investigation by CPS or ACS you owe it to yourself and your children to consult with a CPS lawyer to learn how you can protect your rights and avoid problems with CPS or ACS trying to remove your children from your home.
