Neglect refers to a child, an individual under the age of 18 years of age that has:
- A physical, mental or emotional condition has been impaired or is in immediate danger of being impaired as a result of a failure of a child’s parents or other caretaker to take reasonable action and minimum care of the child:
- In supplying the child with adequate food, clothing, shelter and education. It also applies to providing the child with medical, dental, optical and surgical care.
- Providing the child with proper supervision or guardianship.
- By unreasonable inflicting harm or substantial harm to the child, this includes corporal punishment, or misuse of drugs or alcoholic beverages.
- If a parent loses self-control of the child.
- A personal legally responsible for the child is voluntarily or regularly participating in a rehabilitative program and evidence that she or he has repeated or misused a drug or alcoholic beverage to the extent that he or she loses self-control of his or her actions.
Child Abuse
Child abuse includes serious harm inflicted on children. A child is abused when the lack of care causes serious injury, creates a risk of serious injury or an act of sexual abuse on a child. A person who allows another to cause abuse of a child is also considered abusive.
